This isn’t the first time Beyonce has been sued for being a copy cat and we’re sure this will not be the last. A Hungarian artist by the name of Mitsou has accused Beyonce of sampling her 1997 recording “Gypsy Life on the Road” in the first minute and a half of “Drunk In Love.” She filed a civil lawsuit against the Carter’s claiming “irreparable harm and emotional distress.”
A Manhattan Supreme Court Justice dismissed the claim ruling that the song is a “constitutionally protected work of art.” The judge explained this ruling based on the fact that the law, “does not apply to works of literary and artistic expression,” and since the song and video for “Drunk In Love” are without a doubt “works of artistic expression and, pursuant to well established law, they are therefore exempted from the Civil Rights Law.”
It’s quite interesting how the Carters always seem to win these lawsuits dealing with the use of other artists’ material; as some of you may know Jay-Z just won his lawsuit against Baligh Hamdi, whose song “Khosara, Khosara” was used as a sample for the beat for Big Pimpin’.
Some call it a “technicality,” while others consider it an unfair loophole. Either way, if the woman’s voice was used in any way shape or form she should be protected and profiting from the song as well. It may be in Mitsou’s best interest to go back to court filing a new, more applicable, claim.
